(that link leads to a court case, which goes as follows:
A company that makes games put their logo in their game, because they scan tracks for the game, then add in the logo's for added realism. The flooring company decided to complain five years later about it and got sent to court. So everyone is having a nice bitch, and the case boils down to... is it ok for a company to use another company's logo for added realism, when they didn't ask permission?

it matters what form of "mark" they have.

if the logo was trademarked then they should of asked permission.

but it is all up to the judge.
